1. Acceptable Use Policy
1.1 This Acceptable Use Policy sets out the terms between you and us under which you may access our website sharepeterborough.com (“Share Peterborough”). This acceptable use policy applies to all users of, and visitors to, Share Peterborough.
1.2 Your use of Share Peterborough means that you accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our terms of website use.
1.3 sharepeterborough.com is a site operated by Peterborough City Council (“We”). We are the local authority for Peterborough and our headquarters is located at Town Hall, Bridge Street, Peterborough, PE1 1HG.
1.4 Our intention is that Share Peterborough reflects the ethos and values of the ‘sharing economy’. We believe that these values include pursuing a collaborative approach, fostering shared endeavour, operating fairly and in a spirit of openness, and seeking mutual benefit from working together. We expect users of Share Peterborough to abide by and embody these values in the course of their use of the site and their interactions with other users. If you do not agree to abide by these values and do not intend to use Share Peterborough in the spirit described above, you must not use Share Peterborough.
1.5 Parties may need to seek professional legal and financial advice prior to engaging in the swapping of goods and services with other organisations.
2. Prohibited Uses
2.1 You may use Share Peterborough only for lawful purposes. You may not use Share Peterborough:
2.1.1 in any way that breaches any applicable local, national or international law or regulation;
2.1.2 in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;
2.1.3 for the purpose of harming or attempting to harm minors in any way;
2.1.4 to send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standards;
2.1.5 to transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam); and/or
2.1.6 to knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware.
2.2 You agree that we have absolute discretion as to what content is displayed on Share Peterborough and how such content is managed, and that we may move or delete any content at any time.
2.3 You also agree:
2.3.2 not to access without authority, interfere with, damage or disrupt:
2.3.3 any part of Share Peterborough;
2.3.4 any equipment or network on which Share Peterborough is stored;
2.3.5 any software used in the provision of Share Peterborough; or
2.3.6 any equipment or network or software owned or used by any third party.
3. Interactive Services
3.1 We may from time to time provide interactive services on Share Peterborough, including, without limitation:
3.1.1 facilities for registered users to access, browse, search, post and/or respond to:
(a) news, information, business and events listings;
(b) information relating to the offering and/or requesting of services, skills, goods, assets, facilities and/or physical spaces;
(c) promotions and special offers;
(d) business opportunities such as tender opportunities and job vacancies,
3.1.2 facilities for guest users to access and browse the content described in paragraphs 3.1.1(a) to (d),
3.2 We may carry out validation checks on registered users of Share Peterborough. We are under no obligation to oversee, monitor or moderate any Interactive Service we provide on Share Peterborough, and we expressly exclude our liability for any loss or damage arising from the use of any Interactive Service by a user in contravention of our content standards, whether the service is moderated or not. We will provide facilities for users to contact us about any content which they believe may breach this Acceptable Use Policy and will aim to respond expeditiously to all issues reported by users.
3.3 We do not anticipate that the Interactive Services will be used by minors. Any minor who makes use of the Interactive Services must obtain the consent of their parent or guardian before doing so. We advise parents who permit their children to use an Interactive Service that it is important that they communicate with their children about their safety online and the potential risks associated with internet use.
4. Content Standards
4.1 These content standards apply to any and all material which you upload, post on or add to Share Peterborough, including (but not limited to) text, hyperlinks, photographs and images (“Contributions”), and to any Interactive Services associated with it.
4.2 You must comply with the spirit of the following standards as well as the letter. The standards apply to each part of any Contribution as well as to its whole.
4.3 Contributions must:
4.3.1 be accurate (where they state facts);
4.3.2 be genuinely held (where they state opinions); and
4.3.3 comply with applicable law in the UK and in any country from which they are posted.
4.4 Contributions must not:
4.4.1 contain any material which is defamatory of any person;
4.4.2 contain any material which is obscene, offensive, hateful or inflammatory;
4.4.3 promote sexually explicit material;
4.4.4 promote violence;
4.4.5 promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
4.4.6 infringe any copyright, database right or trade mark of any other person;
4.4.7 be likely to deceive any person;
4.4.8 be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
4.4.9 promote any illegal activity;
4.4.10 be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;
4.4.11 be likely to harass, upset, embarrass, alarm or annoy any other person;
4.4.12 be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
4.4.13 give the impression that they emanate from us, if this is not the case; and/or
4.4.14 advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.
5. Suspension and Termination
5.1 We will determine, in our discretion, whether there has been a breach of this acceptable use policy through your use of Share Peterborough. When a breach of this policy has occurred, we may take such action as we deem appropriate.
5.2.1 immediate, temporary or permanent withdrawal of your right to use Share Peterborough;
5.2.2 immediate, temporary or permanent removal of any posting or material uploaded by you to Share Peterborough;
5.2.3 issue of a warning to you;
5.2.4 legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
5.2.5 further legal action against you; and/or
5.2.6 disclosure of such information to law enforcement authorities as we reasonably feel is necessary.
5.3 We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.
6. Changes to the Acceptable Use Policy
We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on Share Peterborough.
